Terms and Conditions

Section 1: Basic Definitions

  1. Company: Refers to the provider of the Point of Sale (POS) system.

  2. System: The POS system for restaurants and cafes provided by the company.

  3. User: The person or entity using the system to operate their restaurant or cafe.

  4. Service: All services offered through the system, including sales management, inventory, and invoice generation.

  5. Subscription Plan: The package that includes the features and solutions provided to the user based on the subscription agreement.

Section 2: Terms of Use

  1. Eligibility to Use the System

    • The user must be legally eligible to use the system, whether as an individual or a business entity.
    • The user must not have been previously banned from using the system.
  2. User Obligations:

    • The user must provide accurate and correct information when registering for the system.
    • The system must only be used for legal purposes related to operating a restaurant or cafe.
    • The user is responsible for maintaining the confidentiality of their access credentials (such as username and password).
    • The user must comply with all applicable laws and regulations in the Kingdom or the country in which they operate.
  3. License Scope:

    • The user is granted a non-exclusive, non-transferable license to use the system.
    • The user may not copy, modify, or distribute any part of the system without prior written permission from the company

Section 3: Payments and Fees

  1. Subscription Fees:

    • The subscription fees are determined based on the subscription plan agreed upon between the user and the company.
    • The user is obligated to pay the fees on the specified dates; otherwise, the company has the right to suspend or terminate the service.
  2. Price Adjustments:

    • The company reserves the right to adjust prices or impose additional fees for services. The user will be notified of any changes 30 days before they take effect

Section 4: Warranties and Liability

  1. Company Warranties:

    • The company provides the system "As Is" without any specific guarantees regarding service quality or suitability for any particular purpose
  2. User Responsibility:

    • The user agrees to indemnify the company for any damages or claims arising from misuse of the system or violations of the terms of use.
  3. Limitation of Liability:

    • The company is not responsible for any losses or damages that may result from the use of the system, including damages caused by service interruptions or data loss

Section 5: Maintenance and Support

  1. Maintenance and Updates:

    • The company may perform regular maintenance or updates to the system to improve performance or add new features.
    • This may result in temporary service interruptions, and the user will be notified of any planned downtime.
  2. Technical Support:

    • The company provides technical support to users according to the agreed subscription plan. It is preferred to communicate through official support channels (such as email or phone).

Section 6: Termination of Agreement

  1. Termination by User:

    • The user may terminate the subscription at any time by sending written notice to the company. The user is not entitled to a refund of previously paid fees unless otherwise agreed.
  2. Termination by the Company:

    • The company has the right to terminate the subscription or suspend the service if the user violates the terms of use or fails to pay the due fees.

Section 7: Intellectual Property

  1. Ownership Rights:

    • All intellectual property rights related to the system are fully owned by the company. The user may not copy, reproduce, or use the system for commercial purposes without written consent from the company.

Section 8: Confidentiality and Data Protection

  1. Data Confidentiality:

    • The company is committed to protecting the personal and business data of the user in accordance with applicable regulations in the Kingdom.
  2. Privacy Policy:

    • The user must review the company’s privacy policy to understand how personal data is collected and used.

Section 9: Governing Law and Dispute Resolution

  1. Governing Law:

    • These terms and conditions are governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.
  2. Dispute Resolution:

    • In case of a dispute between the company and the user, an attempt will be made to resolve it amicably. If this fails, the dispute will be referred to the competent courts in the Kingdom of Saudi Arabia.

Section 10: Amendments to Terms

  1. Amendments to Terms:

    • The company reserves the right to modify these terms and conditions at any time. The user will be notified of the amendments via email or system notification.
